The Family Mediation Project

    Legal Aid for Family Mediation

Legal Aid may be available to help cover the cost of family mediation for people on a low income. This page explains how Legal Aid for mediation works, what it can cover, and how to access it through appropriate providers.

What is Legal Aid for family mediation?

Legal Aid is government funding that may help eligible individuals pay for family mediation. In mediation cases, Legal Aid is designed to support early resolution of family disputes, particularly where court proceedings may otherwise be considered.

    What can Legal Aid cover?

Where eligible, Legal Aid may cover:

    • the cost of a MIAM
    • mediation sessions
    • preparation work linked to mediation

Coverage depends on individual financial circumstances and the nature of the dispute.

Who may be eligible for Legal Aid?

Eligibility for Legal Aid is based on:

    • income
    • savings
    • financial commitments

Eligibility is assessed by the mediation provider and is subject to government criteria.

    Legal Aid and the MIAM

A MIAM (Mediation Information and Assessment Meeting) is often the first step in the mediation process. If you are eligible for Legal Aid, the MIAM may be covered.

The MIAM explains mediation, assesses suitability, and considers funding options.

    What is a MIAM?

    Important information about Digital MIAM

Digital MIAM does not currently provide Legal Aid-funded mediation.

If you believe you may be eligible for Legal Aid, you will need to contact a mediation provider that offers Legal Aid services.

Legal Aid mediation through National Family Mediation

National Family Mediation (NFM) is a national organisation that provides Legal Aid-funded family mediation through its network of services. If you are eligible for Legal Aid, NFM may be able to support you.

Legal Aid, mediation vouchers, and costs

Legal Aid and the Family Mediation Voucher Scheme are separate forms of support. Some people may qualify for:

    • Legal Aid
    • the mediation voucher
    • or neither

A MIAM helps clarify which options may be available.

If you are not eligible for Legal Aid

If you are not eligible for Legal Aid, mediation is still available on a private basis. Many people choose mediation because it is often more affordable than court proceedings.
